Terms of Service

1. Acceptance of Terms
By creating an account or using StackedIntel™ (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and WiseAI Help LLC ("Company," "we," or "us").
2. Description of Service
StackedIntel™ is a data intelligence platform that aggregates and analyzes publicly available county courthouse and tax records to identify distressed real estate leads. We provide scored lead lists, signal stacking, court enrichment, and deal analysis tools to real estate investors and professionals.
3. Live Data Policy: No Refunds
All fees paid to StackedIntel™ are non-refundable. The Service delivers Live Data, real-time scraped public records that have immediate and lasting value upon delivery. Once data has been accessed, it cannot be returned or un-delivered. This Live Data Policy applies to all plans, setup fees, and add-on purchases without exception. By subscribing, you acknowledge and accept this policy.
4. Service Availability and Billing Adjustments
We strive for maximum uptime but do not guarantee uninterrupted access. In the event of an unplanned platform outage lasting more than 24 consecutive hours due to a fault solely on our end, your subscription renewal date will be extended by the number of affected days, dollar for dollar. No cash credits or refunds will be issued for outages. This adjustment is your sole remedy for service unavailability.
5. Subscription, Pause, and Cancellation
Monthly subscriptions renew automatically each billing cycle. Annual subscriptions renew annually at the rate in effect at time of original purchase for founding members who locked in founding pricing. Pause eligibility requires a minimum of 90 consecutive days of active paid subscription. Eligible subscribers may pause for up to 30 days, up to twice per calendar year. Data is preserved during a valid pause. Accounts that do not meet the 90-day threshold are not eligible to pause; cancellation before that threshold results in permanent loss of accumulated data with no refund. Cancellation takes effect at the end of the current billing period. Access continues through that date. No early termination refund is provided.
6. Single-User Accounts: No Sharing
Each account is licensed to a single individual user. Sharing login credentials, providing access to unauthorized third parties, or circumventing single-user restrictions in any way is a material breach of these Terms and will result in immediate account termination without refund and potential legal action for damages.
7. Acceptable Use: Incorporated by Reference
Your use of the Service is also governed by our Use Policy, available at stackedintel.com/use, which is incorporated into these Terms by reference. Violations of the Use Policy are violations of these Terms and subject to the same remedies, including termination.
8. Intellectual Property
The Service, its algorithms, scoring models, software, and all original content are the exclusive property of WiseAI Help LLC. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own internal business purposes only. You may not reproduce, distribute, resell, or sublicense any portion of the Service or its output.
9. Unpurchased Data: Violation, Forfeiture, and Downstream Liability
You may access, use, retain, or benefit from only the data you have purchased through an active, paid entitlement. Using, copying, retaining, or monetizing any Service data you have not purchased, regardless of how it was obtained, including through a technical fault, data breach, account sharing, re-sharing by another user, or any other means, is a material violation of these Terms. Any gains, profits, or benefits derived from unpurchased data are subject to forfeiture and disgorgement to the Company, in addition to liability for damages, injunctive relief, and recovery of enforcement costs. These obligations bind downstream recipients equally: any person or entity that receives Service data from you, directly or indirectly, is subject to the same restrictions, forfeiture, and liability, and you are responsible for violations committed by parties you shared data with. Every export and data view is forensically watermarked to the receiving account; possession of watermarked data outside a valid entitlement is evidence of violation.
10. Data Accuracy Disclaimer
We aggregate publicly available government records. We make no warranty that data is complete, accurate, or current. County records have inherent delays, errors, and gaps outside our control. Do not rely solely on StackedIntel™ data for legal, financial, or investment decisions without independent verification.
11. Limitation of Liability
To the maximum extent permitted by law, WiseAI Help LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the fees paid by you in the three months preceding the claim.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Florida.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
14. Inventory and Allocation
StackedIntel curates the records it publishes. The inventory shown to any subscriber at any time is a subset of the records StackedIntel holds, selected and ranked by StackedIntel. StackedIntel may, at its sole discretion and without notice, hold back, delay, re-rank, reserve or withdraw any record or class of records from any plan, including records StackedIntel or its affiliates elect to pursue directly. No plan confers a right to any specific record, to the complete inventory of a county, or to records of any particular stack depth, motivation or value.
15. Licence, Not Sale: No Resale, No Scraping, No Circumvention
Records are licensed to the named account holder for that holder's own real-estate investment activity. The licence is personal and non-transferable. The account holder shall not: (a) sell, rent, sublicense, share, publish or otherwise redistribute records or any derivative list to any third party; (b) access the Service by any automated means, including scripts, bots, scrapers, headless browsers or API calls not expressly documented; (c) circumvent, probe or interfere with any access control, rate limit, watermark, download cap or unlock mechanism; (d) share credentials or permit access by any person not named on the account; (e) use records for any purpose prohibited by law, including any purpose governed by the Fair Credit Reporting Act. Any of the above terminates the licence immediately and without refund, and StackedIntel may pursue every remedy available at law.
16. Plans, Unlocks and Download Limits
Each plan carries a monthly allowance of record unlocks and a monthly export cap, both stated on the pricing page at the time of purchase and in the account's billing page. Unlocks and exports are allocated across record classes in proportion to StackedIntel's current inventory and may vary by county and by month. Unused allowance does not roll over. Additional allowance may be purchased where offered.
17. Watermarking, Audit and Attribution
Every screen, export and document delivered through the Service is marked, visibly and invisibly, with identifiers of the account that received it and the time of delivery. StackedIntel keeps an audit record of every unlock, export, download and document retrieval by account. The account holder consents to this marking and record-keeping and agrees that a marked record found outside the account holder's possession is evidence of a breach of Section 15 by that account holder.
18. Nature of the Records
Records are compiled from public sources and delivered as found, with the source cited. StackedIntel does not verify identity, ownership, occupancy or contactability beyond what the cited public record states, and is not a consumer reporting agency.
19. Heir and Court Information
Heir and court information is compiled from public records and cites its source on every line. It is research, not a legal determination of heirship or title. The account holder is responsible for independent verification and for compliance with all laws governing contact with the persons named.
